Welcome to Cheffy. These Terms of Service ("Terms") govern your use of the Cheffy mobile application (the "App") operated by Cheffy ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the App.
To use certain features of the App, you may need to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding the password that you use to access the App and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
The App allows you to create, upload, and share content such as recipes, meal plans, and shopping lists ("User Content"). You retain all rights to your User Content, but you grant us a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to use, display, reproduce, and distribute your User Content in connection with the App.
You agree not to post User Content that:
We reserve the right to remove any User Content that violates these Terms or that we find objectionable for any reason, without prior notice.
The App and its original content, features, and functionality are owned by Cheffy and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
The Cheffy name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Cheffy or its affiliates. You may not use such marks without our prior written permission.
You agree not to use the App:
Some features of the App may require a subscription. By subscribing, you agree to pay the subscription fees as described at the time of purchase.
We bill subscription fees in advance on a recurring basis (monthly, annually, or as otherwise specified). You authorize us to charge your payment method for all fees incurred.
You may cancel your subscription at any time through your account settings or by contacting us. Upon cancellation, your subscription will remain active until the end of your current billing period.
Refunds are provided in accordance with the refund policy of the app store through which you purchased the subscription.
We may terminate or suspend your account and access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination, your right to use the App will immediately cease. If you wish to terminate your account, you may simply discontinue using the App or delete your account through the App's settings.
The App is provided on an "as is" and "as available" basis. Cheffy makes no warranties, expressed or implied, regarding the operation or availability of the App.
We do not warrant that the App will be uninterrupted or error-free, that defects will be corrected, or that the App is free of viruses or other harmful components.
In no event shall Cheffy be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, resulting from your access to or use of or inability to access or use the App.
You agree to defend, indemnify, and hold harmless Cheffy and its officers, directors, employees, and agents from any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.
These Terms shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to its conflict of law provisions.
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our App after any revisions become effective, you agree to be bound by the revised terms.
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
These Terms constitute the entire agreement between you and Cheffy regarding our App and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the App.
